At Pathfinder, LLC (“Pathfinder”), we want you to know how we collect, use, share and protect information about you.  The purpose of this Privacy Policy is to inform you as to what kinds of information we may gather about you, how we may use that information, and whether we disclose it to anyone.  This Privacy Policy applies only to us and our subsidiaries and affiliates, and not to other companies or organizations.

If we decide to change this Privacy Policy, the changes will be posted here in this area so that you will always know the information we gather, how we might use that information and to whom we may disclose it.  We reserve the right, at our discretion to change, modify, add or remove portions of this policy at any time.  Please make sure to check this page periodically for any changes.

Why do we collect your information?

We collect your personal information to enable us to supply, support, and otherwise manage services that you (or a person/company with whom you are associated) acquire or wish to acquire.  We may also use your information for business planning or to provide you with information about our services.  We may also use your information to communicate with you directly, via email, fax, phone, SMS and by other means of communication about possible services.   Without your personal information, we may not be able to supply our services or we may be restricted in the way our services can be supplied.

What information will we collect?

The information we collect from you includes personal information.  Personal information may include your name, your address, your telephone numbers, including your mobile number, email addresses, personal identifiers, bank account or credit card details. Website traffic data may be collected through the normal operation of the Pathfinder LLC Internet servers (IP addresses) or through the use of "cookies". A “cookie” is a small text file that our web server places on a user’s computer hard drive to be a unique identifier. Cookies enable companies to track usage patterns and deliver customized content to users. Pathfinder LLC does not actively market to children and we never knowingly ask a child under 18 to divulge personal information.  We treat information collected by cookies and other technologies as non-personal information.  However, to the extent that non-personal information is combined with personal information, we treat the combined information as personal information for the purposes of this Privacy Policy.  We may collect this information at the following times; (i) when you create an account; (ii) when you register to receive communications from this Site and/or other Pathfinder owned sites; (iii) when you seek information about, or purchase, products offered through this Site or other Pathfinder owned sites; and (iv) when you provide personal information to us through feedback, surveys, or other forms provided on this Site or other Pathfinder owned sites. 

Who might we share your personal information with?

Any personal information collected by Pathfinder LLC will not be sold to any other company or person or to any third party vendor without your consent. Your personal information will not usually be shared with anyone else, unless it is needed in connection with our ongoing supply of services to you and for purposes associated with the supply of those services. We operate both in United States and overseas. Therefore we may need to share some of your personal information with organizations outside United States. We may contract out some services such as background checks and they may receive your personal information, but only so that they can perform services for Pathfinder, L.L.C. 

Finally, we may disclose your personal information to law enforcement agencies, government/regulatory bodies, and content protection organizations to: (i) protect our legal rights, privacy or safety, and that of our subsidiaries, affiliates, employees, agents, contractors, or other individuals; (ii) protect the safety and security of visitors to our online services or other properties; (iii) protect against fraud or other illegal activity or for risk management purposes; (iv) respond to inquiries or requests from government, regulatory, law enforcement, or public authorities; (v) permit us to pursue available remedies, commence, participate in, or defend litigation, or limit the damages that we may sustain; or (vi) comply with the law including with subpoenas, search warrants, court orders, and other legal process

WHILE WE STRIVE TO SELECT THIRD PARTY PARTNERS WHO HAVE OR SHARE THE SAME STANDARDS IN REGARDS TO PRIVACY POLICIES COMPARABLE TO ITS OWN THE USER AGREES THAT WITH RESPECT TO THOSE THIRD PARTIES, INCLUDING WITHOUT LIMITATION THE SITES WE LINK TO, WE DO NOT MAKE ANY REPRESENTATION OR WARRANTY REGARDING THE SAME, NOR WILL WE BE RESPONSIBLE TO THE USER OR ANYONE ELSE FOR ANY PRODUCTS, SERVICES OR OTHER MATERIAL THAT MAY BE SOLD, LICENSED, DISTRIBUTED OR PROMOTED BY SUCH THIRD PARTIES.  WE ENCOURAGE VISITORS OF OTHER COMPANIES’ OR OTHER PERSONS’ SITES TO REVIEW THE PRIVACY POLICIES POSTED ON THESE SITES.

How we protect your personal information

We implement a variety of security measures to maintain the safety of your personal information.  Unfortunately, however, no data transmission over the Internet can be guaranteed to be 100% secure.  Accordingly, while we strive to protect your personal information, we cannot guarantee or warrant the security of any information you transmit to us, or to or from our online products or services.  You transmit all such information at your own risk.

How you can access your personal information or make a complaint?

Our privacy policy contains information about how you may access your personal information and seek correction of such information; as well as how to complain about a breach of the Privacy Principles and how we will deal with such a complaint.

Right to revoke your information?

You may change your mind and revoke (take back) this Authorization at any time, except to the extent that Pathfinder, L.L.C. has already acted based on this Authorization.  To revoke this Authorization (permanently delete), you must write to: Pathfinder, L.L.C. – Data Controller at datacontroller@pathfinderinc.com.

Breach of Supervisory Authority

In the case of a personal data breach, Pathfinder, L.L.C. shall without undue delay and, where feasible, not later than 72 hours after having become aware of it, notify the personal data breach unless unlikely to result in a risk to the rights and freedoms of natural persons.  Where the notification to the supervisory authority is not made within 72 hours, it shall be accompanied by reasons for the delay.

California Privacy Rights/Do Not Track Notice

This paragraph applies only to California residents.  As a California resident, you have a legal right to request and receive in writing or by e-mail the names and addresses of all such third parties who received your personal information during the previous calendar year and a list of the types of personally identifiable information disclosed to such third parties.  To request such information, please send an e-mail to datacontroller@pathfinderinc.com

We will not honor such a request more than once per calendar year.

We do not track our customers over time and across third party websites to provide targeted advertising, and therefore do not respond to Do Not Track (DNT) signals.  However, some third party sites do keep track of your browsing activities when they serve you content, which enables them to tailor what they present to you.  If you are visiting such a site, you may set the DNT signal on your browser so that third parties (particularly advertisers) know you do not want to be tracked.

EU Residents

The following paragraphs apply only to residents of the European Union.

You have a right to be informed of personal information controlled and processed by Pathfinder, a right to rectification/correction, erasure and restriction of processing. You also have the right to receive from Pathfinder a structured, common and machine-readable format of personal information you provided to us.

We can only adhere to your request and provide information if we have personal information about you through you having made contact with us directly and/or you using our Site and/or service.

Where you have provided consent, you may withdraw it at any time, without affecting the lawfulness of the processing that was carried out prior to withdrawing it. Whenever you withdraw consent, you acknowledge and accept that this may have a negative influence on the quality of the Pathfinder Site and/or Services. You further agree that Pathfinder shall not be held liable with respect to any loss and/or damage to your personal information if you choose to withdraw consent.
